We owe nothing to the founders. We certainly aren't religiously obligated to follow their intentions, especially once you actually begin to learn about them as human beings, not as historical figures.<br /><br />Everyone one of them was flawed. So therefore, their "intent" is subject to being questioned by the majority to begin with.<br /><br />And if the Constitution is set up so that the Supreme Court has the final say regarding the constitutionality of legislation, then this is nothing more than another "end run" around the Constitution. Another attempt at subverting the framework of law and order to allow someone (or group) to do something that might otherwise be questionable.
